Zepho Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Zepho website (www.zepho.ai) ("Site") and the Zepho mobile applications available through the Apple App Store and Google Play Store ("Apps"). Please read them carefully before using the Site or Apps.

By accessing or using the Site or Apps, you agree to these Terms and our Privacy Policy. Nothing in these Terms affects your statutory rights as a consumer in your country of residence.

1. About Us

The Site and Apps are owned and operated by Zepho Sports Limited ("Zepho", "we", "us", "our"), a company registered in the United Kingdom with its registered address at 27-37 St George's Road, London, SW19 4EU. Our company registration number is 1658880.

2. Who Can Use Zepho

The Apps are intended for use by individuals aged 18 and over. If you are under 18, you may only use the Apps with the express consent and active supervision of a parent or legal guardian. By allowing a minor to use the Apps, the parent or legal guardian enters into a legally binding contract with us and agrees to be bound by these Terms on the minor's behalf.

We may add, modify, suspend, or discontinue any part of the Site or Apps at any time. If we permanently discontinue any core feature included in your paid subscription, we will provide reasonable notice and, where appropriate, a refund or account credit.

3. Not Medical or Professional Advice

The content and coaching provided through the Site and Apps are for general informational purposes only and are intended for healthy adults. They do not constitute medical, nutritional, or professional advice. The Apps are not medical devices and do not diagnose or treat health conditions.

Before beginning any training plan or physical activity recommended through Zepho, you must obtain clearance from a qualified healthcare professional. Zepho does not assess your health status, physical readiness, or suitability for exercise. You are solely responsible for monitoring your own physical condition and stopping training if you experience pain, dizziness, shortness of breath, or other symptoms.

Always seek the advice of a qualified professional regarding any health concerns. You must not use Zepho to diagnose or treat any medical condition or disregard professional advice based on content within the Site or Apps.

4. Your Use of the Site and Apps

You may only use the Site and Apps for lawful, personal, non-commercial purposes.

You agree not to:

  • modify, reverse engineer, or attempt to extract the Apps' or Site's source code

  • use automated tools to access the Apps or Site

  • interfere with security features or attempt unauthorised access to our systems

  • upload unlawful, infringing, harmful, or misleading content

  • rely on Zepho as a substitute for personal judgement regarding the intensity or safety of your training

User Content

If you submit or upload any content (such as training data, feedback, posts, or messages), you grant Zepho a worldwide, royalty-free, transferable, sublicensable, non-exclusive licence to use, reproduce, modify, adapt, distribute, and display that content for the purposes of providing, improving, and marketing the Site and Apps to you and other users. 

You warrant that you own or have the necessary rights, licenses, and permissions to submit your content and to grant the license set out in these Terms. You are responsible for ensuring that your content does not violate law or infringe third party rights. Zepho may remove or restrict access to any content or account that breaches these Terms.

If we remove your content, we will notify you and explain why, unless doing so would be unlawful or cause harm to other users or our systems. You may appeal our decision by contacting support@zepho.ai.

5. Third Party Integrations

You may choose to connect Zepho with third party services (such as Garmin, WHOOP, Strava, Apple Health, or Zwift). When you do this, we will process data from those services as authorised by you. For more information on data shared with us about you by third parties, please see our Privacy Policy.

Subject to our obligations under the Consumer Rights Act 2015 to provide the Apps with reasonable care and skill, Zepho is not responsible for: 

  • the availability, continuity, or performance of third party services;

  • the accuracy, completeness, or timeliness of third party data;

  • outages, API failures, or changes in third party platforms; or

  • their data handling practices or terms.

Your use of third party services is governed by their own terms and privacy policies. If a third party service becomes unavailable or removes integration access, this may affect Zepho functionality. While we will use reasonable endeavours to restore functionality or provide an alternative, such unavailability does not entitle you to a refund unless the loss of integration constitutes a material breach of our description of the service under applicable law.

6. Subscriptions and Cooling Off Rights

Zepho may offer free trials. Free trials are limited to first time users unless otherwise stated.

If you purchase a subscription, you have a legal right to change your mind and cancel the contract within 14 days of the date of purchase (the "Cooling-off Period") for a full refund. However, if you request immediate access to the digital content and acknowledge that you lose your right to cancel once the download or streaming of the content has begun, you will not be entitled to a refund once you have started using the service. By clicking "Subscribe" or "Purchase", you expressly consent to the immediate supply of the digital content and acknowledge that you lose your 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 .

How subscriptions work

  • Subscriptions purchased through the Apple App Store or Google Play are billed and managed exclusively by those platforms. Zepho cannot modify, cancel, or refund these subscriptions.

  • You must cancel app store subscriptions through your device settings. Cancellation prevents future charges but does not produce a refund for the current billing period.

  • You must cancel before the renewal deadline specified by the app store. We recommend cancelling at least 24 hours before renewal.

  • Subscriptions purchased through the Zepho website or via an event partner will follow the terms shown at the point of purchase.

7. Payments and Refunds

Payment processing depends on your chosen platform.

You may cancel auto-renewal at any time via your device's subscription settings. Cancellation prevents future charges but does not provide a refund for the current period.

In accordance with the Consumer Rights Act 2015, if the digital content we supply is not of satisfactory quality, fit for purpose, or as described, you have the right to a repair or a replacement. If the fault cannot be fixed within a reasonable time or without significant inconvenience to you, you may be entitled to a price reduction (up to a full refund). If our digital content damages your device or other digital content due to our failure to use reasonable care and skill, we will either repair the damage or pay you compensation .

To exercise your right to cancel during the Cooling-off Period, you must inform us of your decision by a clear statement (e.g., an email to support@zepho.ai). 

If Zepho terminates your account without fault on your part, you will receive a pro-rated refund for unused subscription time.

8. Intellectual Property

The Site, Apps, and all related content are owned by Zepho or our licensors. You may not copy or distribute any part of the Site or Apps unless expressly permitted by these Terms.

Nothing in these Terms transfers ownership of your content to Zepho.

9. Data Protection and Privacy

Zepho Sports Limited is the data controller for personal data processed through the Site and Apps.

We process personal data in compliance with the UK GDPR, EU GDPR (where applicable), and other relevant data protection laws.

This includes providing you with rights to:

  • access your personal data

  • correct inaccuracies

  • delete your data

  • restrict or object to processing

  • export your data in a machine readable format

We implement technical and organisational security measures to protect your data. When you connect Zepho with third party services, data transferred from those services will be processed according to your permissions.

10. Disclaimer

The Site and Apps are provided on an "as is" and "as available" basis. While we aim to provide a high-quality service, we do not guarantee that the service will always be uninterrupted, accurate, or error-free. This does not affect your statutory rights under the Consumer Rights Act 2015, which requires that digital content must be of satisfactory quality, fit for purpose, and as described .

We do not guarantee:

  • the accuracy or reliability of training recommendations

  • the suitability of any plan for your personal circumstances

  • uninterrupted access to integrations or third party data feeds

You are solely responsible for your training decisions and for monitoring your own physical condition.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law (including your statutory rights as a consumer under the Consumer Rights Act 2015).

11. Limitation of Liability

Except where prohibited by law, Zepho's total liability to you for any losses you suffer arising from or related to your use of the Site or Apps shall be limited to the total amount you paid to us in the twelve months before the claim arose, or £50, whichever is greater.

We are not responsible for indirect, incidental, or consequential losses, except to the extent that they result from our fraud or fraudulent misrepresentation or any other liability that cannot be excluded under English law.

Assumption of risk

Endurance training involves inherent risks including injury, illness, fatigue, and accidents. You accept full responsibility for your participation in training activities and for interpreting and applying any recommendations provided by Zepho. Zepho is not responsible for injuries or damages arising from your athletic activities except where caused by our negligence or breach of legal duty.

12. Indemnification

You will be responsible for any foreseeable losses, expenses, or other costs (including reasonable legal costs arising from third-party claims) we incur as a result of your breach of these Terms or your unlawful use of the Site or Apps. This does not apply to the extent that such losses are caused by our own negligence or breach of law.

13. Termination

You may terminate your account at any time.

We may suspend or terminate your account if you breach these Terms or misuse the service. Where legally required, we will provide notice and reasons.

If we terminate your account without fault on your part, you will receive a pro-rated refund.

14. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide at least 14 days' advance notice via email or in-App notification.

Your continued use of the Site or Apps after an update constitutes acceptance of the revised Terms.

15. Dispute Resolution and Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer based in the European Union, you may bring proceedings in your local courts. Following the closure of the EU's central Online Dispute Resolution (ODR) platform in July 2025, you should contact your national consumer protection body for information on local Alternative Dispute Resolution (ADR) entities.

You agree to attempt to resolve disputes with us informally before taking legal action.

16. Other Terms

If any part of these Terms is found invalid, the remaining sections remain in force.

You consent to receiving communications from us electronically.

We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets.

These Terms, together with our Privacy Policy, form the entire agreement between you and Zepho.
